Order of the National Green Tribunal (Western Zone Bench, Pune) in the matter of M/s. Omkar Realtors & Developers Pvt Ltd. (R-10) in Appeal No. 14/2014 (WZ) Santosh Daundar Vs. Secretary, MoEF regarding distance between the proposed construction project and Sanjay Gandhi National Park, Boriwali. An affidavit filed by Assistant Conservator of Forest, Sanjay Gandhi National Park, Boriwali has stated that “in relation to the proposed project for which EIAC was granted to this project, which is in Malad (east), the ESZ strip as proposed is 100 mtsr wide as the locality is already developed. However, this proposed ESZ of Thane Forest Division, has not yet been delineated and approved. Until such approval and delineation of the ESZ of 100 mtrs from Sanjay Gandhi National Park for Malad (East) locations, it is the MoEF guidelines/ Notifications which would prevail. “
