Order of the National Green Tribunal in the matter of Shailesh Singh Vs Bajaj Hindustan Sugar Ltd. (Distillery Division) & Others dated 01/08/2019 regarding pollution by M/s Bajaj Hindustan Sugar Ltd. (distillery division), village – Paliakalan, District Lakhimpur Kheri, Uttar Pradesh.

As per report received from the Central Pollution Control Board (CPCB) the unit was noncompliant and a show cause notice was issued for closure till pollution control measures are implemented. And in furtherance to the report, the Tribunal directed a Committee of CPCB and State Pollution Control Board (SPCB) to oversee further action and furnish an action taken report. The joint inspection was done on May 24, 2019 and report submitted before the NGT. The report stated that the distillery unit was not yet fully compliant with the pollution control measures, particularly Zero Liquid Discharge (ZLD) and bio composting. Therefore, Environmental Compensation (EC) needs to be recovered from the unit and direction given for closure of the unit. EC of Rs. 58,20,000 /- should be imposed on the unit for the continuing violation.

The NGT gave its approval to the CPCB observations and recommendations and directs that compliance be ensured and a further report filed by November 30, 2019.
