Factual and action taken report in compliance to the National Green Tribunal order of October 16, 2019 in the matter of Sitesh Kumar Gunjan & Others Vs State of Bihar.

The matter related to illegal encroachment and water pollution of stream at village Pokharpur, district Nalanda, Bihar by the running of a hotel and rice mill.

During inspection, it was found that the hotel was constructed just on the bank of the Pawa Pine canal. The effluent treatment plant of the rice mill was found non functional. The paddy-husk generated from the unit was also stored in open space and most of the conditions imposed in the Consent to Operate (CTO) issued by the Bihar State Pollution Control Board was not complied with. The proprietor of the Pawapuri Rice Mill had applied for CTO under the Water Act, 1974 and Air Act, 1981 which had expired on December 31, 2018 and it was under consideration with the SPCB.
