Compliance report on behalf of Rajasthan State Pollution Control Board in the matter of Madansingh Chauhan Vs State of Rajasthan.

The report was in compliance to the National Green Tribunal (NGT) order of October 17, 2019 for inspection of Bhagwati stone crusher in village Jaswar, district Bharatpur. It was alleged that the stone crusher was located within 200 meters of the school and close to the habitation. Further, it was resulting in environmental degradation and affecting public health.

The SPCB informed the NGT that the stone crusher was having valid consent to operate. The RSPCB had conducted inspection and air monitoring of the disputed stone crusher on September 20, 2019. As per the inspection report, the project proponent had installed covers on vibrating screen, jaw crusher and granulator. Wind breaking walls, boundary wall and hard surface road was also constructed and the project proponent had done more than 33% plantation.

Another inspection was done by the RSPCB on March 12, 2020 for verification of nearest school and habitation around M/s Bhagwati Stone Crusher. The headmaster of the school and the villagers of Jaswar (the nearest village) has said that there was no objection from their side to the operation of the stone crusher. The report informed the Tribunal that geographically the crusher was bounded with rocky hills from three sides and these rocky hills are working as wind breakers for the crusher.
