Order of the National Green Tribunal regarding illegal encroachments, Meerut, Uttar Pradesh, 11/09/2020

Order of the National Green Tribunal in the matter of Dr. Ajay Kumar Vs Union of India & Others dated 11/09/2020. Grievance in the application was that land reserved for park and open space as per Master Plan 2021 was sought to be encroached at Khaduli, Baghpat road over bridge and proposed bus stand at National Highway-58, Meerut, by-pass Modipuram by-pass to Khirwa Road and at Bhola Road, Village Sudpur alias Pathanpura adversely affecting the environment.

An action taken report on the matter was filed by the District Magistrate, Meerut, Meerut Development Authority (MDA), Municipal Commissioner, Meerut and Uttar Pradesh Pollution Control Board (UPPCB). The report informed the Tribunal that MDA had taken action against the unauthorised construction in different areas along with the areas proposed for parks, open spaces and green belt in Meerut Master Plan-2021, in accordance with the relevant provision under the Uttar Pradesh Urban Planning and Development Act, 1973 by issuing 255 notices. In accordance with the aforesaid provisions the proceedings for sealing and demolition of unauthorized illegal construction was in progress. Up till now 8 unauthorized constructions had been sealed. Demolition orders for 50 unauthorized constructions have been passed - in which demolition would be effected after the entering of the period prescribed in law.

The NGT taking into consideration the report, directed that MDA should take further action for enforcing the law and complete the same within three months. Further, the action taken report should be submitted to the Oversight Committee constituted by the NGT, headed by Justice S V S Rathore, former Judge, Allahabad High Court by December 31, 2020. Thereafter, the matter would be monitored by the Oversight Committee.
