Order of the Madras High Court in the matter of G. Sundarrajan Vs Union of India dated 31/08/2012 regarding the clearance granted by the Atomic Energy Regulatory Board for 'Initial Fuel Loading' [IFL] and 'First Approach to Criticality' [FAC] of Unit 1 of Kudankulam Nuclear Power Project.

Madras High Court refuses to declare as null and void the clearance granted to Unit 1 of Kudankulam Nuclear Power Project [KKNPP] for 'Initial Fuel Loading' and 'First Approach to Criticality' and clearly stated that once the AERB has initiated the measures, it is not for the Court " to substitute its view with that of the regulatory body. Law is well settled that when two views are possible and the authority who is an expert has taken one view, it is not for the Court to substitute it with another view under any circumstance."
