Order of the National Green Tribunal in the matter of Sudiep Shrivastava Vs State of Chhatisgarh & Others dated 11/02/2020 regarding utilization of fly ash generated by thermal power plants.

The NGT directed the Ministry of Environment, Forest and Climate Change to proceed in the matter by following the directions given in the matter of Shantanu Sharma Vs. Union of India & Others (O.A. No. 117/2014).

The order had called for the formation of a Joint Committee to finalize an action covering all aspects "so as to not only achieve 100% utilization of fly ash but also to ensure its scientific and environmentally sound disposal." The Committee would also be required to determine the amount of damages to be paid for the violation of requirement of utilization of fly ash. The report needs to be submitted within two months and pending submission of such report, all the thermal power stations who had failed to dispose of 100% fly ash up to December 31, 2017 would be required to deposit damages for environment restoration.
