The Bombay High Court Tuesday asked the state government to look into suggestions of making small waste disposal units mandatory in residential societies and townships by amending building by-laws and development control regulations. A division bench of Justices N H Patil and V L Achliya was hearing a public interest litigation (PIL) filed in 2009 by one K D Gokhale and others in 2009. This matter, being heard by the HC for the past six years, talks about plans for a waste treatment plant, to be set up by the KDMC, lying in limbo for want of sanction for more than 15 years. In April, the HC had directed KDMC not to give any further permission for residential and commercial constructions, stating that they first needed to tackle their garbage dumping problem. “We clarify that constructions which have already started, projects in which sanction has been given by KDMC, projects which have received commencement certificate, partially constructed projects and redevelopment projects can continue,” the bench said. The court said that individuals and societies should take responsibility of waste management and disposal. “We cannot shirk basic responsibilities and then blame the government and corporation. The tendency of throwing garbage on the road needs to be changed,” said the court. The court will hear the matter on June 24.
