MSEB serves 'retaliatory' notice on DPC

In a counter stragety to tame the belligerent Enron-promoted Dabhol Power Company (DPC), the Maharashtra State Electricity Board (MSEB) on Thursday served on it a 'voiding' notice accusing the former of having failed to adhere to the performance promised by it in the Power Purchase Agreement (PPA). In its notice served less than a week after the DPC having slapped a Preliminary Termination Notice (PTN) on the MSEB, the state electricity board retaliated by charging the Enron-promoted company with having fallen 'short' in power generation and supply performance and saying that the 'shortfalls' and the subsequent information provided to it amounted to 'misrepresentation' of the facts. "Therefore, the contract between the MSEB and DPC is violable," the notice stated.
