BHOPAL : “Can you file an affidavit that DJ operators have not violated the instructions of NGT in the last six months”, the Central Zone Bench of National Green Tribunal asked of the counsel for Bhopal DJs’ Welfare Society here on Tuesday.
The Bench had banned the use of DJ during marriage processions and other functions in the first week of this month.
The Bhopal DJs Welfare Society filed an affidavit on Tuesday stating that they will abide by the rules and regulation prescribed for them. They sought interim relief from the ban imposed on them.
During the course of the hearing, the Bench commented that the DJ operators were violating the directives and if the ban is removed, then who will take the responsibility for violation. The counsel for DJ association said that the state or any other authority can take any action, even up to lodging an FIR.
After the hearing, the bench asked the counsel for state government Sachin Verma to file a reply on the next date of hearing.
The DJ association submitted to the bench that they will use single theatre sound system, will stop playing music in silent zones, will not play the music after 10 PM and will follow the guidelines of Supreme Court.
The counsel for applicant Vivek Chaudhary had taken objection to the interim relief application of DJ association.
Speaking to Free Press Journal, Vivek said that DJ operators were violating the Motor Vehicles Act and Noise Pollution Rules 2000. “DJ operators are also violating a 2005 judgment of the Supreme Court”, he added.
Vivek told the bench that in spite of the NGT’s order, DJs are being operated in marriage and other parties. The case would be next heard on January 22.
Sellers of substandard polythene bags to deposit Rs 50K security
In a petition filed against the shopkeepers selling polythene bags below standard of 40 microns, NGT ordered them to deposit security of Rs 50,000 on Tuesday. During the hearing counsel for shopkeepers told the bench that the work of cleaning the railway track has been started and the same will be completed by December 27. The bench in its earlier order directed to clean the railway tracks as punishment for selling the substandard polythene bags. However, the delay in following the directives of NGT, the bench was displeased and ordered to deposit the security. The bench in its order said that if the directions are not fulfilled within the said time limit then their security amount will be forfeited by NGT. The Bench has also asked the railways to submit its report on the work done by violators. The case would be heard on January 11.
