TN govt directed to remediate Noyyal river

THE Madras High Court on Thursday directed the State government to make all ef- forts to remediate the issue involving pollution in the Noyyal river in Karur dis- trict.
A division bench compris- ing justices Elipe Dharma Rao and N Paul Vasanthaku- mar gave the direction while setting aside an order dated December 29, 2004 of the Loss of Ecology (Prevention and Payment of Compensa- tion) Authority, which said that compensation was pay- able for loss in production of pre-dominant crops only and not for individual crops.
Thee Authority had also or- dered a meager amount as compensation.
KK Subramanian, S Lak- shmi and S Selvakumar owned 10.50 acres on the left- side bank of the Noyyal riv- er in Thoppampatti village in Karur district. Contend- ing that the yield from their land drastically went down due to the pollution caused by the dyeing and bleaching units in Tirupur and the units situated on the banks of the river, the petitioners claimed a total compensa- tion of about Rs 19 lakh from the Authority.
By the December 2004 or- der, the Authority said that the petitioners were eligible for compensation. It, how- ever, fixed the same at a total sum of Rs 2.16 lakh. Hence the present writ petition.
Allowing the petition, the bench observed that there was abundant material on record in the form of expert reports before the Authority to assess the loss sustained by the petitioners. ``Viewing from this angle, we have no hesitation to hold that the compensation awarded by the Authority is very mea- ger, besides being bereft of consideration of the entire facts and circumstances of the case,'' the bench said. It quashed the 2004 order and sent the matter back to the Authority for consideration of the entire aspect of the compensation claim within two months.
