Order of the National Green Tribunal in the matter of Gagan Narang Vs Union of India & Others dated 22/11/2022.

The Municipal Corporation of Delhi (MCD) has to take necessary precautions to ensure that no leachate goes from the Bhalswa site to the adjacent drain and the same is not blocked. Current waste should not be dumped at Bhalswa and utilization of segregated inert waste need to be followed, directed the bench of Justice Adarsh Kumar Goel and Justice Sudhir Agarwal of the NGT, November 22, 2022.

The court noted that fresh waste is still being dumped at Bhalswa dumpsite despite NGT orders. Further no engineered sanitary landfill has been set up as required. Request for proposal (RFP) document, July 15, 2022 has been prepared to set up a waste to energy plant at Narela-Bawana. However, terms laid down therein are not compliant with SWM Rules, 2016.

"Another parcel of land has been identified at Sultanpur Dabas for landfill site and bidder for WTE has been allowed to dispose of inert at Bhalswa dumpsite in violation of para 38 of order of this Tribunal dated 11.10.2022," mentioned the NGT order, November 22, 2022.

Gagan Narang in his application before the NGT voiced his grievance against the proposed waste to energy (WTE) project at Narela-Bawana, Delhi. He said that the MCD has not been able to take adequate action for compliance of Solid Waste Management Rules, 2016 for scientific handling of the waste generated in Delhi.
