Order of the National Green Tribunal in the matter of Sachin Dave Vs Union of India & Others dated 13/07/2023.

The matter related to encroachment and pollution of river Kshipra, a tributary of river Ganga in Madhya Pradesh.

The NGT directed the Joint Committee to give details of flood plain zone of river Kshipra, programme for rejuvenation, the action taken plan in respect of removal of encroachment and whether any funds have been provided by National Mission for Clean Ganga since river Kshipra is a tributary of Ganga and is governed by Provisions of River Ganga (Rejuvenation, Protection and Management) Authorities Order, 2016 and if such fund has been provided, in what manner, such a fund has been utilised.

The tribunal also directed the District Magistrates, Ujjain, Indore, Dewas and Ratlam to submit separate report with regard to the status of river Kshipra in their respective districts which will include encroachment status, discharge of industrial effluents, municipal and domestic sewage and the measures of treatment of such discharge undertaken by respective bodies, agencies or individuals, as the case may be.

The NGT also directed that on the next date of hearing (August 16, 2023), the Additional Chief Secretary, Water Resource Department, Madhya Pradesh and Member Secretary, MPPCB shall also appear in person before the NGT.
