Order of the National Green Tribunal in the matter of Akshay Kumar Singh & Others Vs Union of India & Others dated 14/08/2023.
The matter related to the establishment of a garbage processing unit at Poiwan, Aurangabad, Bihar by the Aurangabad Municipal Corporation.
The grievance of the applicants was that the said garbage processing unit is near the village of the applicants which has a dense population and the river Tekari is within 50 to 100 meters from the said unit. The dumped garbage is stated to be stored at about 300 meters from the village where the entire district’s garbage is stored and the waste processing unit has been established by the district administration.
The NGT directed notice to be issued to the authorities to file their counter-affidavits on the matter. The tribunal wanted to know whether the siting criteria laid down for establishment of such waste processing unit has been strictly followed.
