Order of the National Green Tribunal in the matter of Crossings Republik Flat Owner Association Vs State of Uttar Pradesh dated 29/11/2023.

In this original application, Applicant has questioned the setting up of a Bio-CNG plant with 300 TPD capacity at Khasra Nos. 121, 122, 123, 124, 129, 304, 305 and 306 of village Dundahera of Ghaziabad, Uttar Pradesh.

As per the allegation, the tender has been awarded to Everenviro Resources Management Pvt Ltd and the concession agreement, November 24, 2022 has been entered into and the activity has already commenced. The complaint of the applicant is that the proposed plant is located adjacent to the densely populated village and that the plant is proposed to be located near the hospitals and schools. The applicant has referred to a map and said that the proposed plant has a common boundary with residential inhabitants and institutions. Further, the Bio-CNG plant is categorized as 'Orange/Red' category industry depending upon the discharge of wastewater.

The NGT, November 29 directed notice to be issued to Uttar Pradesh Pollution Control Board, Ghaziabad Nagar Nigam, District Magistrate Ghaziabad, state of Uttar Pradesh and Everenviro Resources Management, the project proponent.

The next date of hearing has been fixed for February 2, 2024.
