Order of the National Green Tribunal in the matter of Anuradha Vs State of Uttar Pradesh dated 15/03/2021. The matter related to violation of environmental norms by Triveni Sugar Mill in village Milk Narayanpur, tehsil Tanda, district Rampur, Uttar Pradesh.

The NGT after going through the reports filed by the joint committee constituted to look into the matter said it was seen that the unit was operating beyond the consented capacity, without a separate flow meter, ETP operation was inadequate and there were other inadequacies in the operation of the unit.

The court noted that even though there were serious violations of environmental norms, the concerned authorities failed to perform its responsibility of assessing and recovering compensation on 'polluter pays' principle and taking other remedial measures to ensure compliance.

Taking into consideration, the above factors, the Tribunal directed the joint committee to assess compensation following due process of law. The state PCB must ensure recovery of compensation and also ensure that the unit remedies the contamination of groundwater and soil.
