Judgment of the National Green Tribunal in the matter of Nirmal Kumar Tripathi Vs State of Uttar Pradesh & Others dated 09/04/2024.

The NGT said that the geo-physical setting of the city of Deoria results in serious water logging problems during monsoon. Thus, the project scheme of storm water drainage planned in Deoria for the control of waterlogging problems should be undertaken. "However, slabs on the top should only be on those location/places where requirement/necessity of right of the way arises," the order said.

The court directed that the excavated soil should be stored in a designated place to avoid its spread on the road and prevent dust pollution. The water tankers should be in place for spraying water on the affected areas to prevent dust from being airborne. The plantation on both the banks of the storm water drain should be carried out by suitable grasses, shrubs and native trees including bamboo for the protection of banks from erosion and enhancing aesthetic/scenic value of the drain. Further, there should be foolproof mechanism to prevent mixing of municipal sewage into the storm water, the court said.

The applicant had said that earth being excavated for digging of the drain was causing air pollution and problems to the residents nearby.
