The Delhi high court has sought a reply from the Union government on a petition challenging a provision in the Patents Rule, 1972. The petition, relates to processing of international applications in the country under a single window system through the Patent head office in Calcutta. A division bench comprising Justices Devender Gupta and S K Aggarwal while issuing notices asked ministry of industries, controller-general of patents, designs and trademark to file replies by September 14. The petitioner said the act does not make any distinction between the patent head office at Calcutta and its branch offices in Delhi, Mumbai and Chennai, while exercising its powers.
